Welcome to Hired by Noon (“Platform”, “we”, “us”, “our”). These Terms & Conditions (“Terms”) govern your access to and use of our services, including our website, software, and applications, whether as a company (employer) or as an applicant (user).
By accessing or using Hired by Noon, you agree to be bound by these Terms and our Privacy Policy.
1. Who We Are
Hired by Noon is a software-as-a-service platform operated by Unicorn Machine OÜ (“we,” “us,” “our”), a company registered in Estonia (registry code: 17188733). The platform provides video-based candidate screening, AI-powered applicant evaluation, technical assessments, and automated job matching.
2. Private Beta
The Platform is currently offered as a private beta. Employer access is granted by invitation after we review a beta access request, and we may decline or withdraw an invitation at our discretion.
During the beta, the Platform is provided free of charge. Features may change, be added, or be removed at short notice, and we do not offer an availability or support commitment. Any paid plan offered later will be governed by separate order terms agreed with you.
If you send us feedback, bug reports, or suggestions, you grant us a perpetual, worldwide, royalty-free licence to use them to improve the Platform, without any obligation to you.
3. Eligibility & Account Creation
To use the Platform, you must be at least 18 years old and legally able to enter into binding contracts. Companies may register through authorised representatives. Users must provide accurate and complete information when creating an account or submitting an application, and are responsible for keeping their account credentials secure.
4. Use of the Platform
For Employers
You may create and manage job postings, define screening criteria, and access candidate profiles, video submissions, session recordings, and assessment results. By using the Platform’s AI-based evaluation features, you acknowledge that these features may fall within the EU AI Act’s high-risk categorisation for recruitment systems, and that you are responsible for complying with any resulting obligations, including maintaining human oversight of significant hiring decisions.
For Applicants
You may submit video responses, provide background and personality information, complete technical assessments, and be considered for current and future roles based on your profile.
The Platform uses AI-based tools to help screen and evaluate applications. Applicants are informed when an AI system is part of the evaluation process. See our Privacy Policy for details on how this works, including your right to request a meaningful explanation, human review, and to contest an automated decision.
5. Interview Recording & Assessment Integrity
Some stages of a hiring pipeline record video and audio, produce automated transcripts, and capture what you write in the in-browser code editor. Your browser will ask for permission before your camera or microphone is used, and no recording takes place without it. If you do not want to be recorded, you can choose not to complete that stage — but the employer may not be able to progress your application.
Technical assessments record integrity signals such as pasted content and typing activity inside the assessment editor. These signals are shown to employers as context and are not, on their own, a determination that a submission is dishonest. You must not misrepresent your work, have someone else complete an assessment for you, or attempt to circumvent assessment controls.
The Platform does not monitor other applications, other browser tabs, or anything else on your device.
6. Acceptable Use
You may not:
- Use the Platform in violation of applicable laws.
- Distribute, resell, or frame any part of the Platform.
- Interfere with the operation of our services, or attempt to gain unauthorised access to any account, data, or system.
- Scrape, harvest, or bulk-export candidate data, or use automated tools to submit applications.
- Upload another person’s personal data — including a CV or video — without a lawful basis for doing so.
- Use candidate data obtained through the Platform for any purpose other than the role it was submitted for, unless the candidate has consented.
- Use the Platform to discriminate unlawfully against candidates.
7. License to Use
We grant you a limited, non-exclusive, non-transferable, and revocable license to use our services for your internal business (employers) or personal (applicants) purposes.
8. Data & Privacy
By using Hired by Noon, you acknowledge and agree to our collection, storage, processing, and use of your data as described in our Privacy Policy, which forms part of these Terms. That policy also explains the cookies and analytics technologies we use, including session-recording analytics.
For candidate data submitted to a specific role, the employer running that role acts as data controller and we act as a processor on their instructions. We act as controller for platform-level data such as accounts, security logs, beta access requests, and product analytics.

9. Employer Responsibilities
If you use the Platform as an employer, you agree to:
- Have a lawful basis for processing every candidate’s data, and tell candidates how their data will be used.
- Keep meaningful human oversight of decisions that significantly affect a candidate, and honour requests for human review.
- Configure screening criteria and automatic filters so they are job-related and non-discriminatory.
- Comply with applicable employment, equal-treatment, and data protection law in every jurisdiction you recruit in.
- Enter into a data processing agreement with us where one is required.
You remain responsible for your hiring decisions. AI-generated scores, summaries, and insights are decision support, not a decision.
10. Intellectual Property
All content, software, and features on the Platform are the intellectual property of Hired by Noon or its licensors. You may not copy, modify, or distribute any part of the Platform without our prior written consent.
You keep ownership of the content you submit — your CV, video responses, and assessment work. You grant us a licence to host, process, transcribe, analyse, and display that content to the employer you applied to, for the purpose of operating the Platform.
11. Third-Party Services
The Platform depends on third-party providers for hosting, storage, authentication, email, AI processing, and analytics. We are not responsible for outages, changes, or failures in those services, and their availability may affect the Platform.
12. Termination
We reserve the right to suspend or terminate access if you violate these Terms, misuse the Platform, or engage in fraudulent activity.
You may also delete your account at any time.
13. Disclaimer of Warranties
The Platform is provided “as is” and “as available”, without warranties of any kind, whether express or implied. We do not warrant that the Platform will be uninterrupted or error-free, that automated transcripts, scores, or insights will be accurate or complete, or that the Platform will identify the best candidate for a role. This is particularly true during the beta.
Nothing in this section limits rights you have under mandatory consumer protection law.
14. Limitation of Liability
To the maximum extent permitted by law, Hired by Noon shall not be liable for:
- Indirect, incidental, or consequential damages.
- Any loss of data or reputation.
- Hiring decisions made by employers based on platform results.
This limitation of liability does not affect your rights under GDPR, the EU AI Act, or other applicable data protection and anti-discrimination laws.
15. Modifications
We may update these Terms from time to time. Significant changes will be communicated via email or platform notification. Continued use after changes constitutes acceptance.
16. Governing Law
These Terms are governed by the laws of the Republic of Estonia. Any disputes shall be resolved in the courts of Tallinn, Estonia.
